BRAZIL: POLITICAL CRISIS, LEGAL ENVIRONMENT AND BUSINESS PROSPECTS

Brazil is facing an already longstanding political crisis with major impacts on its economy and business environment. At the center of this crisis lie the corruption investigations that started around 2014 and have already caused the impeachment of former President Dilma Rouseff, the imprisonment of several high-profile politicians and businesspeople, and  the deterioration of the financials of many of Brazil’s largest corporations. Navigating this complex scenario requires an adequate understanding of the changes in Brazilian legal environment that resulted in and made possible  such current outcomes. Brazil´s uncertainties notwithstanding, business opportunities are available everywhere for those who can understand these changes and properly evaluate the corresponding risks.

Senior partners Tito Andrade and Marcos Verissimo from prominent Brazilian law firm Machado Meyer will address these issues and  the context of the Car Wash scandal and its far reaching impact (current and future) on businesses, with a particular focus on the risks involved in the acquisition of the many assets related to the affected companies which are now being marketed.

Bios:

Tito Amaral de Andrade is a partner in the Antitrust and Compliance practices of Machado Meyer. He was born in Rio de Janeiro, Brazil, in 1972, and graduated from the Catholic University of Rio de Janeiro in 1995. He holds a Master of Laws (1999) from the  London School of Economics. Tito joined Machado Meyer in 2000, after working for the General Secretariat of the European Commission, in Brussels, Belgium (1999/2000) and for the Rules Division of the World Trade Organization, in Geneva, Switzerland (2000). He has been one of the leading antitrust lawyers in Brazil for more than a decade, and has represented countless Fortune 500 companies in some of the most complex merger transactions and antitrust investigations that took place in Brazil over these years. He is a member of several professional associations, including the International Bar Association and the Brazilian Bar Association, is a former President of the Brazilian Institute for Competition, Consumer Relations and International Trade Studies (IBRAC, 2012/2013) and a former Co-chair of the Antitrust Committee of the American Chamber of Commerce in Brazil (Amcham).

Marcos Paulo Verissimo is a partner in the Antitrust, Compliance and Public Law practices of Machado Meyer. He was born in São Paulo, Brazil, in 1974, and graduated from the University of São Paulo Law School in 1997. He holds a Master of Laws (2002) and a Doctor of Laws (2006) degrees also from University of São Paulo, where he currently serves as a Tenured Professor of Public Law. Marcos was also a visiting scholar at the Yale Law School in 2005. Marcos joined Machado Meyer in 1999 and left the firm to serve as a Director and Chief of Staff at the Brazilian Development Bank (2009-2011) and as a Commissioner at the Brazilian Antitrust Authority (2011-2013). In 2013, after leaving the Federal Administration, Marcos returned to the firm, and has been very active in complex merger cases, antitrust and anticorrution investigations,  compliance matters, and telecom regulation. He is a member of the Brazilian Bar Association, where he serves as a member of the Special Commissions on Antitrust Law and Regulation and Constitutional Law, and of several international associations such as the International Bar Association, the American Bar Association, etc.
